Terms and Conditions

1. Agreement to these terms

These Terms and Conditions ("Terms") govern your access to and use of MyGarage and related services (the "Service"). By registering for an account, clicking to accept these Terms, or using the Service, you agree to be bound by them.

If you do not agree, do not use the Service. We may update these Terms as described in Section 16; continued use after changes take effect constitutes acceptance.

2. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract. You represent that the information you provide is accurate and that you will keep your account credentials confidential.

3. The Service

MyGarage provides tools to manage personal vehicles, including maintenance and expense tracking, document and photo storage, reminders, analytics, marketplace listings, ownership history, secure transfers between users, and optional public vehicle profiles.

We may modify, suspend, or discontinue features at any time. The Service is provided for personal garage management unless we agree otherwise in writing.

The Service is currently offered as a public beta. During this period, access is provided free of charge. We may introduce paid plans, usage limits, or other pricing changes before or after general availability. We will provide reasonable notice before any paid features take effect for existing accounts, where practicable.

4. Your account

You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

You may delete your account at any time from Settings. Deletion is permanent and removes your vehicles, records, and uploads as described in the application, subject to limited retention where required by law or for provenance integrity.

5. Your content

You retain ownership of content you submit (vehicle data, photos, documents, listings, and similar materials). You grant us a non-exclusive, worldwide license to host, store, process, display, and transmit your content solely to operate and improve the Service, including features you enable (such as public profiles, marketplace listings, or PDF exports).

You represent that you have the rights to upload and share your content and that it does not infringe third-party rights or violate applicable law.

6. Marketplace listings

Listings are provided by users, not by us. We do not guarantee the accuracy of listing information, vehicle condition, title status, or the conduct of buyers or sellers. Any transaction is solely between the parties involved.

You choose what contact information to display. Exercise caution when communicating with strangers and meeting for vehicle inspections or sales.

Reporting listings

If you have an account, you may report a marketplace listing you believe is misleading, fraudulent, or otherwise violates these Terms. You must provide a good-faith reason. False or abusive reports may result in action against your account. Reports are reviewed by our team; we are not obligated to remove content in every case.

7. Moderation and suspension

We may remove or suspend marketplace listings, display site-wide notices about outages or policy issues, and suspend or terminate accounts that violate these Terms, applicable law, or that pose a security or fraud risk. Where required for legal compliance, we document moderation decisions including the reason and time.

If your account is suspended, you will be notified through the Service and may contact us using the details in our Privacy Policy if you wish to appeal or request information about the decision, subject to applicable law.

8. Vehicle transfers and ownership history

Transfer invitations are time-limited and tied to the invited email address. You are responsible for verifying the identity of the other party before completing a transfer.

Ownership history and provenance features are informational records based on user-submitted data. They are not a substitute for legal title transfer, bill of sale, or government registration requirements in your jurisdiction.

9. Public profiles and privacy settings

When you enable a public vehicle profile, you control what categories of information may be visible via your privacy settings. You are responsible for reviewing those settings before sharing a profile link.

10. Acceptable use

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes
• Upload malware or attempt to breach our systems
• Scrape, reverse engineer, or overload the Service without permission
• Impersonate others or misrepresent vehicle ownership or history
• Harass other users or publish content that is defamatory, obscene, or infringing
• Circumvent access controls or security measures

We may remove content and terminate access for violations.

11. Intellectual property

The Service, including its software, design, branding, and documentation (excluding your content), is owned by us or our licensors and protected by intellectual property laws. You receive a limited, revocable license to use the Service for its intended purpose.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that data (including maintenance reminders, cost analytics, health scores, or exchange-rate conversions) will be accurate for your specific situation. You are solely responsible for vehicle safety, maintenance decisions, and compliance with laws.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VEHICLE VALUE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100), IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

14. Indemnification

You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your listings or transfers, or your violation of these Terms or third-party rights.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access with or without notice if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

16. Changes

We may revise these Terms by posting an updated version on this page. If changes are material, we may provide additional notice. Your continued use after the effective date constitutes acceptance.

17. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of MyGarage is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.
